§ 38-9. Violation and penalty.
(a)
Whenever any act is prohibited by this chapter, or is made or declared to be unlawful, or an offense, or the doing of any act is required or the failure to do any act is declared to be unlawful, the violation shall be punished by a fine not to exceed the amount of one thousand dollars ($1,000.00) or imprisonment for a term not to exceed six (6) months, or by both such fine and imprisonment.
(b)
Notwithstanding subsection (a) of this section, violations of this chapter may be charged as infractions, and if so charged, shall be punishable by the following fines, pursuant to section 25132 of the Government Code:
(1)
A fine not exceeding one hundred dollars ($100.00) plus penalty assessment for a first violation.
(2)
A fine not exceeding two hundred dollars ($200.00) plus penalty assessment for a second violation within one (1) year.
(3)
A fine not exceeding five hundred dollars ($500.00) plus penalty assessment for each additional violation within one (1) year.
