§ 4-40. Issuance authorized.

The County of Butte hereby authorizes the health officer, public health director, and employees of its health department's rabies control and animal control programs to issue notices to appear in court pursuant to chapter 5C (commencing with section 853.5) or title 3 of part 2 of the California Penal Code for violations of this chapter. The health officer or public health director may authorize humane officers appointed pursuant to section 14503 of California Corporations Code to issue such notices to appear.

No such officers, employees and authorized humane officers, however shall be authorized to take any person into custody even though the person to whom the notice is delivered does not give his written promise to appear in court. The authority of any such employees under this section is limited to the jurisdiction of the County of Butte.
