§ 13-106. Application review procedure.
Upon receipt, the Planning Division shall distribute copies of the mining permit application, reclamation plan, and financial assurance cost estimate and/or provide notice, as required, to the Butte County Public Works Department, the Butte County Environmental Health Division, the Butte County Water Commission, the Committee and responsible agencies, including, but not limited to, the Department of Conservation, the United States Army Corps of Engineers, the California Department of Fish and Game, the California Department of Water Resources and the Central Valley Division of the Regional Water Quality Control Board.
Whenever mining operations are proposed in the 100-year floodplain for any stream and within one (1) mile, upstream or downstream, of any State highway bridge, the Planning Division shall, pursuant to Public Resources Code Section 2770.5, notify the State Department of Transportation, that the application has been received.
Within sixty (60) days of the distribution of the permit application, reclamation plan, and financial assurance cost estimate the Committee shall meet to review them and make recommendations to staff. The Planning Division shall be responsible for developing an agenda and setting the time and place for the Committee meeting. Notice for said meeting shall be provided to all property owners whose property fronts on a private road used to access the mine site. Application review by the Planning Division shall not be delayed by an inability to schedule a meeting with the Committee.
